Who Enforces?
“If you put restrictions on, do you have the authority to enforce those restrictions?" Schaefer asked the BZA.
“The county has." Gardiner replied, adding that anyone could report violations of the permit conditions to the commonwealth attorney. "We have a new commonwealth attorney who would enforce the restrictions this board puts on...We had a previous commonwealth attorney who had no interests, no initiative in anything this board did...We previously had difficulty in getting the commonwealth attorney to prosecute any violations." the BZA chairman said, adding that a case involving removal of an illegal trailer was taken all the way to the State Supreme Court and was upheld, only to have the commonwealth attorney refuse to take any action.
Gardiner added that the BZA can also rescind any special use permit if conditions are not met. His suggestion that a temporary special use permit be issued met with no response from the other board members, despite Johnson's adding that he had no objections to issuance of a permit for three or four years.
Maintaining that it’s “in the interests of the county to have the building cleaned up." the BZA voted unanimously to grant the special use permit with the stipulations that repairs cease at 10:30 p.m.. that no inoperable vehicles be parked on the lot, that there be no discharge of solvents and liquid wastes into the Thornton River and that noise "be kept to a minimum."
