In considering Johnson’s request for a. special use permit, the BZA members did not seek legal counsel. Commonwealth attorney Douglas Baumgardner, who also serves as county attorney for local governing bodies, disqualified himself from advising the BZA in this case on the grounds that Johnson is a client and business associate.
Louise Varner, who lives within 100 feet of the old coop, also spoke at Thursday’s hearing against granting the special use permit. “I’m a widow and I live alone. 1 feel reasonably secure now but if that (the body and paint shop) is across the street from me, it would attract all kinds of people.
