Settlement Pre-empts Rating

The out-of-court settlement reached May 13 was occasioned by construction activity at the NPEA site and a petition filed the same day for a temporary injunction from commonwealth's attorney Douglas Baumgardner on behalf of the county. The petition noted that the NPEA did not obtain a building permit for the construction as required by the zoning ordinance.

Baumgardner also stated that the county "has reason to believe that the said NPEA intends to use its property for a campground meeting this year irrespective of whether the Court makes a ruling as to the merits of this cause or not prior to the date of such meeting.”

The injunction request was dropped along with the county's request for a ruling on the validity of the zoning
