"After 15 years with the opportunity to do this and no one did anything, I don’t feel this is . the time for negotiations,” Johnson replied. In response to a question from Estes on ownership of the property, Johnson said settlement was set for 9 a.m. the following day, regardless of the BZA’s action, with a selling price of $8,000. “And I intend to go through with it.”

If Johnson proposed to work on solely his own cars in the body and paint shop, Estes interjected, only a building permit from the zoning administrator is required, not a special use permit from the BZA.

Zoning secretary Patty Alexander countered that the BZA must issue any building permits for improvements to a structure in a flood plain.

Gardiner added that the zoning administrator issues some permits himself for improvements and renovation of flood plain property and sends others on to the board for approval. “I don’t know what formula he uses,” the BZA chairman added.
