Rappahannock New* Staff I ritcr Conflicts in the county’s zoning regulations were highlighted in a variance request considered bv the Rappahannock Board of Zoning Appeals on February 5, prompting the BZA to table the application, pending legal advice.
At issue at the meeting was a request from Wayne Jenkins for a variance on side setback regulations. The county’s zoning ordinance requires a minimum of 50 feet sideyard set back for single family residential structures on agriculturally zoned land.
Jenkins told the BZA that he holds a sales contract for a tot on Route 626 near Washington that is 95 feet wide at its widest point. “It will not meet the side setback requirements for issuance of a building permit," he said, noting that the lot was recorded prior to the 1973 adoption of the zoning ordinance.
The ordinance limits granting of a variance to situations in which strict application of zoning regulations would produce undue hardship. It further specifies that such hardship must not be shared generally by other properties in the area; that authorization of the variance must not change the character of the neighborhood or be detrimental to adjacent property.
In regard to hardship, BZA chairman Lee Bird asked if Jenkins would be able to develop the lot without a variance.
