Association’s legal counsel and after discussing the matter with the circuit court judge hearing the case, Baumgardner disqualified himself on the grounds that he might be called as a material witness. (And he was subpeonaed for a pre-trial hearing held February 25.)
It would be a disservice to all parties concerned if we repeated the rumors Johnston referred to in his column. If the allegations he made are true, the facts will come out at the trial set for March 23. Then and only then, do they merit publication.
Johnston notes that there are people “who believe that this case will make the county look so bad that it may still never come to trial.”
