The Rappahannock News, represented by Luke, immediately lodged a request to re-open the proceedings. With the request denied, the paper then sought status to intervene and presented a motion at Tuesday’s hearing to open the record.
Earlier Closure
At the outset, Judge Home acknowledged that prior to the February 2!> closed proceedings in Rappahannock, an earlier closed hearing had been held in Leesburg. At the first. Home said, he heard a motion in limini (to limit the scope of evidence that may be introduced at Kidwell’s trial) and at the second, a motion to dismiss the charges against the defendant. The grounds for the two motions and the evidence presented for both are included in the portion of the record that the court has ordered sealed, he noted.
