The record on two hearings held to date in the murder trial of Diane Elizabeth Kidwell will remain sealed —> at least until after the case goes to a jury sometime in late March.
In Leesburg on Tuesday, Circuit Court Judge Thomas Horne maintained that he would be “derelict" in his responsibility if he granted a motion from the Rappahannock News to open the record on two “closed door” hearings and pleadings filed in the case.
“This court is not in a position to win a popularity contest,” Home said, emphasizing that he must balance his responsibility to ensure that the defendant and the Commonwealth get a fair trial against freedom of the press and the public’s right to know.
