Flint Hill. Spellman was felled by a shotgun blast in the chest while reportedly widening a right-of-way that served the Kidwell property and three lots owned by Patricia Saltonstall, owner of Points-of-View Farm.

Kidwell was indicted for murder a month after the shooting following a special grand jury investigation requested by Commonwealth’s Attorney Douglas Baumgardner. In January, acting on advice from the State Bar Association, Baumgardner disqualified himself from persuing the charges on grounds that he might be called as a material witness. In response, Judge Home named Steven Merrill, former assistant prosecutor for Fairfax County who is now in private practice, as special prosecutor.

First Amendment issues became involved in the case when Home ordered a February 25 pre-trial hearing on motions closed to the press and the public and the major portion of the record sealed.
