“It was not only Diane Kidwell but the Commonwealth’s Attorney of Rappahannock County (Douglas Baumgardner) who urged me to make the motion (for closure),” Dowd continued. “I understand he’s written a letter saying he wats it opened up now. . . I don’t think that’s fair.”
“I never agreed one way or another (to the closure),” Merrill interjected, noting he wanted the record clear.
In stating that he would deny Luke’s motion if the Rappahannock News didn’t agree to a continuance until after Kidwell’s trial, Judge Home stressed that his decision for closure was not made lightly. “The decision was made after a great deal of thought. . . This case is different from anything I saw as a prosecutor,” said Loudoun’s former commonwealth’s attorney. “It’s different from anything in the lawbooks.”
