Council member Newbill Miller said that he had no objection about having another hearing but said that a new hearing could not invalidate the special use permit which was previously granted. He also stated that “we can’t do anything binding” at the meeting held on December 5 because Mr. Kramer had not given proper notice to council members.
All of the members were present except for William Wickens. Mr. Kramer said that he tried repeatedly to contact Mr. Wickens but was unable to reach him. Attorney Doug Baumi idner, who was attending a Water and Sewer Authority meeting in the courthouse, was asked for advice.
“To be on the safe side each member should be given written notice of the meeting,” said Mr. Baumgardner.
Mr. Kramer said that he called the special meeting in order to give citizens an opportunity to respond to the special use permit within a 30 day period. “I am trying to avoid putting somebody between a rock and a hard place,” he said.
After re-checking a calendar it *^vas decided that the regular Town Council meeting, to be held on December 11, would still be within that period.
The parking issue caused much discussion at the meeting. It was generally concluded that only one or two buildings in the town currently meet the conditions of the present ordinance. Mr. Miller said that the council would not be able to hold the Krebser and Martin' Partnership to one standard while allowing a different standard for others.
Dr. Werner Krebser, who was in attendance, said that he would “not stand still” on the issue. If he is to be held to the ordinance, he said, “every building is going to have it.”
The major said,“There is a basic disagreement on the council as to what parking may be.”
Realtor Eileen Day said that she was concerned that the ordinance based its parking provisions on square footage rather than actual usage.
