Many Virginia farmers face difficult alternatives. They can risk being fined or jailed, they can switch to less labor-intensive crops, they can try to recruit domestic workers, or they recruit seasonal foreign workers who have permits issued by the | Department of Justice.
The Immigration Reform and Control Act legalizes the status of foreign workers who have been here continuously since Jan. 1,1982.
Workers who arrived since 1980 or who have gone back and forth between the United States and their native country are slated to be deported. The only way they can come back legally is through the new H-2 Temporary Foreign Worker Program.
Farmers may want to check into the H-2 program for seasonal labor but past experience with similar programs indicate they will face a lot of delays and red tape. Workers hired under this program must be paid minimum wages, and they must be housed and transported according to prescribed regulations. Farmers who hire them should be willing to accept inspections by governmenttype persons.
The INS suggests that in order to avoid potential problems, farmers hire registered crew leaders when employing foreign workers. Also, farmers should check the documentation of the crew leaders and the workers.
