Luke said, should be made before the next Circuit Court Term Day, which is July 9. If sufficient evidence is found to warrant prosecution, the evidence could be presented to a grand jury at that time. The grand jupr would then find either that sufficient evidence exists to certify the charges for prosecution, or that insufficient evidence was presented. In that case the charges would be dropped.
