In execution of a deed of trust dated March 28, 1995 (the "Deed of Truer), recorded in the Clerk's Office of the Circuit'Court of Rappahannock County, Virginia, in Deed Book 215 at Page 435, the undersigned Trustee will offer for sale at public auction 8.4150 acres on east side of Route 611, near Amissville, Virginia - Tax Map #3226A, (the “Property"), as more particularly described in said Deed of Trust
.The sale will take place on Thursday, March 7, 1996, at 1:00 P.M., at the front entrance of the Rappahannock County Courthouse in Washington, Virginia.
A bidder's deposit of $4,370.00 in cash or by Certified or cashier's ChecK will be required of each bidder other than the Noteholder. The Trustee reserves the right to waive or.modify the requirements of the bidder's deposit. At the conclusion of the sale deposits of the unsuccessful bidders will be returned, and the successful bidder will be required to execute a written cpntrdct for the-purchase of the property. The purchaser’s deposit, without interest, will be applied to the purchase price at settlement. The balance of the purchase price, plus interest on such balance at the rate of 10% per annum from the date of sale through the date of settlement, will be due in immediately available funds at settlement, which shall occur no later than fifteen (15) days after the sale.
The property will be sold "AS IS", and conveyed by Special Warranty deed, subject to the lien of a superior deed of trust in the original amount of $194,000.00, • and to all other recorded and unrecorded liens, judgments, rights, reservations, covenants, easements and restrictions as may lawfully affect the Property. Neither the Trustee nor the Noteholder will deliver possession of the Property to the Purchaser.
