Circuit Court Judge Carleton Penn denied the defense’s motion. As it was lunchtime, he dismissed the jurors for a lunch break but had Mr. Gray arrested to ensure his presence at 1:15.
Mr. Gray testified that he had done a job for a Russell Pullen who was a different man than the Russell Pullen who was in court to testify that the checks were from his account. He said that he had received the two checks in Fairfax. He admitted signing one , saying that he did so because Mr. Pullen had forgotten to; he said that the cashier said that would be okay. She later testified, during rebuttal, that when the checks were presented to her they were already signed.
