Spokesman Murtaugh said January’s court date won’t affect their successful convictions. As a case of firsts, however, the court was willing to hear Obion out, he said.
“We flatly reject [Obion’s motion]. The law is plain and clear,” said Murtaugh.
Virginia law says spam sent through Virginia’s Internet, “or into the computer network,” is a crime. The punishment is up to 15 years in jail and fines up to $7,500.
AOL spokesman Nicholas Graham called Virginia’s law - which was crafted with the help of AOL - “one of the top online consumer laws in the country.”
“We believe this (law) will turn the tide against spammers,” he said.
