With the case over and out of the courtroom, angry citizens accosted the prosecuting attorney, asking how this “travesty of justice could be made?”
Hennesey briefly explained the Virginia Code to them and its definition of “obscene.”
In response to the court’s decision, Konick said, “the Commonwealth’s Attorney recognized no factual basis for a criminal charge and the warrant shouldn’t have been issued. It is further confirmed by the fact that the Commonwealth’s entire record of this matter will be expunged at the conclusion of six months.”
“I will be watching Mr. Konick like a hawk,” said the victim in the case, Donald Hill of Castleton, “he is an officer of the court and he is supposed to uphold the laws and values of the court.”
Konick was charged with indecent exposure in an incident that occurred on February 12 when Konick allegedly “pulled down his pants and exposed his buttocks” to the victim over a dispute on property boundaries.
