BOARD OF ZONING APPEALS

RAPPAHANNOCK COUNTY, VIRGINIA Pursuant to Section 170-129 ot the Rappahannock County Code and Section 15.2-2204 of the 1950 Code of Virginia, as amended, notice is hereby given that the Board of Zoning Appeals for Rappahannock County, Virginia, will hold a public hearing on Wednesday, January 28, 2009 at seven-thirty in the evening in me Courthouse in Washington, Virginia, in order to consider the following applications:

SU #08-11-01 Chester Gap Baptist Church, owner of 39.72 acres on Headwaters Road, Chester Gap (Tax Map 1, Parcel 87, zoned VR-Village Residential, Wakefield District), by David M. Falkenstein of Greenway Engineering, Inc. - Agent, desire a Special Use permit to build a place of worship. Use allowed pursuant to Code Section 170-36B, with additional standards under Code Sections 170-63A and 170-631, of the Rappahannock County Code.

SU #08-11-02 Scott A. and Elizabeth M. Whitty, owners of 29.99 acres on River Mountain Lane, Amissville (Tax Map 23, Parcel 21, zoned A -Agricultural, Jackson District), desire a Special Use permit to construct a family apartment for their daughter. The main dwelling will be constructed at the same time. Use allowed pursuant to Code Section 170-36A, with additional standards under Code Section 170-62G, of the Rappahannock County Code.

No applicant or other party in interest, and no attorney for an applicant or party in interest, shall initiate a contact with a member of the BZA for the purpose of conducting a private discussion, in person or by telephone, concerning the merits of any application, appeal, or other matter pending before the BZA. No member of the BZA shall participate in any such private discussion. Site visits pr similar contacts initiated by BZA members shall not constitute such e* parte contacts. A copy of the foregoing applications are on file at the Zoning Office in Washington. Virginia, and are available for public inspection. Monday through Friday, 8:30AM to 4:30PM. Said applications will be presented to the Rappahannock County Planning Commission at their regular meeting on Wednesday, December 17, 2008 at seven-thirty in the evening at the Rappahannock County Courthouse for such recommendation as the Commission may wish to make pursuant to Section 170-55, if any. The above-named applicants, adjacent property owners, and any other parties desiring to be heard should be present at said meeting or should address their written comments to the Board of Zoning Appeals, do PO.
