Sutherland appeared to have fallen asleep as he drove south from Front Royal to Madison with his passenger, Brian Scott Henderson of Chester Gap, 44, although no one can say for sure what happened. There was no evidence of drug or alcohol use, Thomas said.

Henderson, who was treated for cuts, bruises and a likely concussion at Warren Memorial Hospital, afterward told police he does not remember the crash, Thomas said.

After veering right into a culvert, Thomas said, Sutherland’s car headed back across the northbound lane, down a slope and and then skidded sideways into a tree, the brunt of the impact coming at the driver’s side door.

Henderson was wearing a seat belt, Thomas said, and Sutherland was not.
