talked with Carter outside before the shooting, were teasing the defendant about the loss of his girlfriend.
“I wouldn’t use the word tease,” Dennis responded. “It was kind of like a quiet down conversation . . . from the parts I heard.” He reported Carter’s voice was low and didn’t sound angry or mad but rather depressed when the defendant said Anna Rose Gatewood was his woman and should be with him “after nine years.”
“I don’t know if they lived together for nine years,” Dennis said in response to a question from Davis. ”1 heard Carter say that they had been together for nine years.”
Dennis acknowledged that he didn’t take Carter’s remarks as a threat towards either of the victims.
In cross examination, Biddle asked Dennis why he had been scared of Carter. “He could have shot me and took my truck,” the witness answered. “Why did you think he might,” asked Biddle. “Because he had the gun,” Dennis responded. When both attornies had finished questioning Dennis, Judge Penn asked the witness if he’d told anyone at the party that he’d left Carter on the road with a loaded shotgun.
