Mrs. Corbin’s son, Bobby Lee Corbin, 31, died December 26, 1978, of injuries he sustained in an automobile accident while driving under the influence of alcohol on Christmas Day. Following the accident, he was taken to the county jail and held from 6:30 p.m. on the 25th until 10:30 a.m. the next day. According to the suit, Corbin collapsed shortly after his release and died a few hours later in Warren Memorial Hospital.
Mrs. Corbin charged that the callous indifference of Buntin and Mannion while Corbin was in custody caused her son’s death. She maintained in her suit that the injuries would not have been fatal if Corbin had received medical treatment.
In his order. Judge Turk noted that Mrs. Corbin had failed to allege any personal connection between the sheriff and denial of the decedant’s constitutional rights. "Indeed, the complaint does not allege that Sheriff Buntin had any knowledge of the incident in question." the judge wrote.
