In answer to a request for dismissal of the charges against Mannion, Turk wrote that the court couldn’t say that ‘‘it appears beyond doubt that the plaintiff can prove no set of facts in support of his claim which would entitle him to relief." The judge denied the motion for dismissal because the complaint “can clearly state a cognizable claim” against the correction’s officer which must be resolved.

A holiday dinner to benefit the annual seventh grade trip to Williamsburg will preceed the Christmas program set for Thursday, December 20, at 7:30 p.m, in the elementary school auditorium.

On the menu are spaghetti, salad, garlic bread and drinks. Dinner, at $2.25 per person, will be served from 5 to 7 p.m. Tickets are available at the door or from members of the seventh grade class.

For a complete night at the theater, diners are invited to stay for the free Christmas performance of “The Small ■ One.” presented by fourth and fifth graders, plus several numbers by the elementary “ school band: The prqgrttm will begin at 7:30 p.m.
