Douglas C. Baumgardner, commonwealth’s attorney for Rappahannock County, has been named special prosecutor in the embezzlement case against a former employee of the Airlie Foundation.
Fauquier’s commonwealth's attorney Charles Foley and his assistant Roger Inger were relieved by Circuit Court Judge Shore Robertson of prosecuting the charges. Robertson acted on an October 10 request from the two lawyers who asked that they be removed on the basis of conflict of interest.
Both attorneys also represent Airlie employees in a federal grand jury investigation.
Former Airlie employee Robert T. Curtis of Manassas is charged with embezzling S735 from the foundation in August, 1975. Allegedly, Curtis obtained endorsement from the foundation's director Dr. Murdock Head or forged the signature on a check dated July, 1975, drawn on the National Bank of Washington.
Judge Robertson’s order relives Foley and Inger from prosecuting any other cases resulting from investigations of former Airlie employees as well as the case against Curtis.
