According to commonwealth's attorney Douglas Baumgardner, the Virginia Code gives the remaining members of the board of supervisors authority to fill the vacancy created by Luke’s resignation. If the supervisors cannot agree or do not act within 30 days of July 1, the appointment will be made by Circuit Court Judge Shore Robertson.
Whether named by the supervisors or the Judge, the appointee, who must be a qualified voter in Piedmont District, will serve until the general election in November, 1981. At that time, the voters in Piedmont District will choose someone to finish out the remaining two years of Luke’s unexpired term.
