Based on that case and rules of construction, Baumgardner concludes that “a church-related school such as that being operated on the premises of the Massanova Pentecostal Church falls within the narameters of the term ‘schools, public and private,” as s$t forth in the Rappahannock zoning ordinance.
“In expressing this opinion, I attach great weight to the nature of the curriculum being offered by this church-affiliated school...Such curriculum is varied and constitutes a use of the premises as an educational facility seeking to instruct students in secular pursuits as well as in matters of a purely religious character,” Baumgardner concludes.
According to local health department sanitarian Jack Lockhart, there are no special health department regulations which apply to schools.
He noted that the Massanova Pentecostal Church’s septic system is not adequate to serve the 22 or 23 students reportedly attending classes there on a daily basis. As a result, he said, two portable toilets have been put in at the church parking lot.
This arrangement is satisfactory with the health department on a temporary basis, Lockhart said, noting that expansion of the septic system is not feasible until the county settles the zoning question involved with the church school.
