Convicted robber. Tracy Franklin was given a five year sentence with tour years suspended. He began serving time in Fauquier on November 8 and was scheduled to go on work release but acceptable program couldn't be arranged, Buntin reported. Franklin has cerebral palsy and is being kept in isolation, the sheriff said. This week, Fauquier officials announced they could no longer spare the space. "Now we have to move Franklin ijnd I don’t know where he’s going to go. We can’t really ask another jail to take him when one jail has already turned him out," Buntin said. Stuart's court appointed attorney Lee Albrecht is meeting this week with Judge Shore Robertson .lo try to find a solution, the /meriff added.
"I don’t know^what we're going to do (with Stuart und other local prisoners). But we have to do something,” Buntin concluded.
Under Virginia law, the board of supervisors is responsible for providing a county jail and can be compelled by the circuit court to erect and repair a facility that meets minimum standards specified by the Department of Corrections.
The supervisors adopted a 1982-83 budget that doesn’t include a line item for jail renovation. They planned to dip into the county surplus—then projected to be $200,000 at the close of the fiscal yean—to pay for the renovation project. And they anticipated that half the costs (somewhere between $32,500 and $75,000, depending on which estimate is used) would be reimbursed by the state.
Notified on Monday by Guest that reimbursement was no longer a part of the proposed state budget. Supervisor Chairman J. R. Latham took a grim view of the financial picture: "I don’t think we cttsi handle it without help.’
