Revisions to conflict of interest laws proposed by Attorney General Gerald Baliles call for a legislative inquiry and review commission to investigate complaints involving General Assembly members. The attempt to establish an independent legislative ethics commission promises to be unpopular with the legislators who prefer to police themselves. Noting that he hasn’t read the attorney general’s proposal. Guest said he has no problem with adequacy of current procedures which call for the House of Delegates’ privileges and elections committee to look into alleged misconduct of its members.
As to the package of anticrime bills supported by Baliles and Gov. Robb, Guest’s reaction is mixed. “I’ve* seen parts of it and parts of it are pretty good,” he said. He’s opposed to broadening the state’s wiretapping powers, as proposed by Robb and Baliles, and doubts if modification of the exclusionary rule (which bars use of evidence seized illegally by police) should be considered when that same issue is currently before the federal court. “I’m not sure it’s the proper time, not when we’re waiting for an answer from the federal court,” Guest said. He’s in favor of giving the prosecution limited right of appeal in criminal cases.
