commission chairman A.Y. Stokes’ suggestion, safety regulations controlling the storage of ammunition will be required. Rather than setting a fee schedule for safety and noise inspections by experts in those fields, the range amendment specifies that the applicant for the special use permit must provide certification that safety and noise regulations are satisfied.
“I still can’t bring myself to agree with 500 feet (as setback distance) from adjoining property lines,” said Latham.
The proposed amendment states that ranges must be located 500 feet from property lines but adds a proviso that the board of zoning appeals can increase or decrease that distance upon consideration of the physical characteristics of the range and the adjoining property, explained commonwealth’s attorney Douglas Baumgardner. “It gives the BZA greater flexibility.”
“I’d like to see that minimum raised,” Latham said.
“This basically sets 500 feet as a starting point,” replied Baumgardner.
“Why 500 feet? Why not 1,000 feet?” asked supervisor H. B. Wood.
Maybe Arbitrary
“Originally we had 1,000 feet,” planning commissioner Werner Krebser responded. The planners felt that safety considerations could be covered by adding specific design criteria for a shooting range while noise and impact on neighboring property values from a range could be controlled by regulations on lot size, he said. “We were told that 1,000 feet might be arbitrary. It amounts to approximately 100 acres of land while 500 feet amounts to about 25 acres.”
Baumgardner reminded the supervisors that they could make minor changes to the proposed amendment at their public hearing without re advertising, provided that fhe changes don’t alter the basic character of the amendment. —
