Governor Robb has asked me to thank you for your recent letter.

The Governor has requested and received Frank F. Everest, Jr.’s resignation as a member of the Virginia Commission of Game and Inland Fisheries.

Frank Sutton, III was charged with and convicted for shooting within 38 feet of a road in violation of S 18.2286 of the Code of Virginia which prohibits shooting within 100 yards of a road. At the same time, he was in compliance with the Nelsqn County Ordinance which permits hunting with a firearm beyond 10 feet of a 1 road. Obviously, the law and the county ordinance are contradictory.

Following the Sutton ■ case, the Commission of Game and Inland Fisheries requested the advice of the Office of the Attorney General to clear up this confusion. It was agreed that in counties having local ordinances pertaining to hunting in the vicinity of public roads, game wardens will consult with the local Commonwealth’s Attorneys to determine how the laws will be enforced.
