Following a five minute recess, District Court Judge John Alexander agreed that the prosecution had failed to establish that Haase had been in possession of the promises at the time of the seizure in August. However, Alexander said he would not decide the search and seizure aspect of the case.
Konick and Haase left the courtroom with smiles. The case was cleared.
The only conviction to date in Rappahannock County arising from last summer’s Virginia Marijuana Eradication Program came during the October 25 session of general district court. Joseph and Madeline Ferguson of Woodville each received a 30 day suspended sentence and were each fined $100 plus court costs.
