Judge John Alexander dismissed a charge of driving while intoxicated (DWI) against Curtis Wade Andre Tuesday in General District Court.
Judge Alexander said the charge was not proved beyond a reasonable doubt that Andre had been driving recklessly.
Andre still must face a charge at a later date of refusing to take a breathalizer test.
