Drivers charged with driving un der the influence of alcohol will nov have the option of getting either i blood test or a breath test to deter mine alcohol levels.
On Monday Commonwealth At tomey Peter Luke urged the Boart of Supervisors to approve funding for blood tests for drivers suspectet of DWI. Virginia law requires giving the option of both tests if they ar< available. Mr. Luke told member! that he lost a drunk driving case be cause the judge agreed with the de fendant’s claim that he was no offered both tests. The judge rule< that the driver could have beei taken to Fauquier Hospital for ad ministration of a blood test.
Mr. Luke said that this places t burden on the police department. H< also said that after being taken t< Fauquier Hospital the suspect couk conceivably change his decision “When they see the needle, a lot o them change their minds,” said Mr Luke.
A nurse who previously adminis tered the blood test recently re signed. According to Mr. Luke th< job has the dual pitfalls of bad paj and bad hours. “Usually these things happen.
