In the process of drafting and adopting that ordinance, the county produced a program that it can use — and has used, in the rezoning for Ashbum Village, a planned 5,000home development east of Leesburg — under existing state law.
“But for the legislation that was passed last year, we could have done what we’ve done under the existing enabling authority,” said Edgar A. Prichard, the Fairfax attorney Loudoun hired to draft its ordinance.
If the county already has used the program in approving Ashbum Village, Sen. John W. Russell (RFairfax) asked, “Why do you have a bill here now?”
Loudoun County Attorney Edward J. Finnegan explained that the ordinance contemplated last year differs from the ordinance adopted by the county for this year’s session.
