“The hardship for me is the seventh lot,” Mr. Mitchell said. “I’d be glad to locate the houses differently. If you’re judging the subdivision by where these circles are, don’t.”

“Hardship has a lot of meanings,” Mr. Olson said. “But the number of lots was never included in the definition of hardship.”

“If the slopes were in one part of the parcel, I would feel more strongly about having one larger lot,” Dr. Krebser said. “There will be 25 plus acres in every lot even if it is seven lots. The slopes per se do not bother me, even if it is the law.”

Dr. Krebser made a motion to recommend approval of the special exception. Mr. Clark and Mr. Stokes joined him in voting for it. Mr. Massie voted against the motion.

In other action, the Planning Commission:

• decided to wait until the February meeting to elect a chairman and vice-chairman when perhaps more members would be present.

• learned that the application for a special use permit for Spring Mountain School has been withdrawn because of highway department concern about the entrance on Route 600.

• recommended denial of Robert Misdom’s request to rezone his 7.32 acre parcel on Route 611 near Amissville from Agriculture to R-2 because it would constitute spot zoning.

• withdrew the application to rezone land owned by Bruce Vierling to Village Commercial. The rezoning had been recommended for sewage disposal for Robert Metcalfe’s proposed apartments in the old Flint Hill packing shed also owned by Mr. Vierling. Mr. Metcalfe’s engineer said that the land was not suited to a septic system and will instead recommend land in the rear of the building for the drainfield.

• tabled Reed Payne’s request for a special use permit for a pool/billiards amusement arcade at his mother’s garage on 1.1 acres on U.S. 211, just east of Washington.

• voted to advertise the county’s proposed Capital Improvements Plan for public hearing at the Planning Commission meeting on Feb. 21.
