The Washington Town Council passed three subdivisions and held a two-hour public hearing on the proposed new Subdivision Ordinance before holding it over a month at its March meeting last Wednesday night.
The council approved a request by Steve Critzer, agent for his late father Wallace’s estate, to subdivide a 1.98-acre lot on Warren Avenue into lots of 1.48 and .5 acres.
The council did not act on a recommendation from the Planning Commission that approval be linked to screening of the equipment yard. Town attorney Frank Reynolds advised the council that screening is properly the subject of the Zoning Ordinance.
A question that did arise from Mr. Reynolds was whether or not the subdivision would create “one equipment yard, not two.” Mr. Critzer said the intent was to “draw an imaginary line through an existing piece of property. ... I question whether this is part of our subdivision application.”
Mr. Reynolds suggested, “If you want to approve this, say you’re not adding any non-conforming uses. It makes it a zoning issue."
Approval, with the no-non-conforming-use language, was approved 5-1. Council member Ray Gooch voted against the application, he said, because “I really have a problem in approving a subdivision application when the property is not in compliance with the Zoning Ordinance.”
