velopment. “It’s going to force me to build in places I didn’t want to,” he told the council.
However, as Mr. Reynolds pointed out, the Subdivision Ordinance would have to be changed again in order for an existing subdivision to be subject to the three-year rule. Although Town Council members themselves struggled to explain it precisely, they seemed to agree that wording in the new (proposed) ordinance meant that Mr. Lynch’s site plans and others that already exist will be valid forever, until and unless the town changes the new (proposed) ordinance again.
He also said, “If you’ve got a site plan approved allowing you to have an off-site drainfield, then you’re grandfathered.”
Mr. Reynolds suggested that the council add an “executive summary” to the Subdivision Ordinance that would more precisely state the intent of the three-year grandfathering rule.
Council member Mark Bailey brought up the question of plat requirements. In cases where the new (proposed) ordinance requires certain diameters of pipe, or “standard” parking lot dimensions, he wanted to know where the specifications were found.
‘There’s a lot of stuff in the site plan that’s ridiculous for someone building a home to comply with,” he said.
The council agreed to make pipe sizes subject to Virginia Department of Health and Town of Washington Water Works approval.
Mayor Dean Morehouse suggested using Virginia Department of Transportation standards for sizes and varieties of parking spaces.
The council tabled the ordinance for a month to come up with the “executive summary” pertaining to the three-year grandfathering provision.
The Historic District Ordinance (HDO) was also discussed, following a series of amendments done by the Planning Commission.
