Philip Smiley, the neighbor whose property is on the side the Dupagans have chosen for the addition, also gave the board a letter signed by him and his wife supporting the application. Mr. Smiley said his house is 1,000 feet from the Dunagans’ house, and he added he would have no objections if they wanted to build right up to the property line.
Chairman Louis G. “Butch” Zindel noted that the board could not grant a variance as a “special convenience” for the applicant. He said he could only be granted for an “undue hardship” or one “approaching confiscation.”
Member Sid Gottlieb said, “One problem for me is one wants to be a nice guy, but when we apply some of these tests, it slows me up a bit.”
County Administrator John McCarthy said, “On the whole issue of a hardship approaching confiscation, if we take that literally very few things fit that, but we have had a couple. If this was an existing three or four bedroom house, and they were seeking to add two more, that would not be a hardship approaching confiscation. But this is a two-bedroom house and they can’t build on the three other sides. What’s the reason for allowing a variance at all?”
Jdr. Zindel said, “After last month, I know that few approach confiscation.”
