Mr. Gottlieb said, “I try to keep in mind consistency.” In the Schiermeyer case last month, “a house could be built in conformance, and it would fit in with the neighborhood. Do we do this on a case-by-case basis depending on whether it bothers anybody near them? The setbacks were established with care.”
“The setbacks were established to protect the neighbors," member Jimmy Swindler Jr. said.
Mr. McCarthy said there might be reasons a neighbor would not want to oppose an application publicly. “They shouldn’t have to come out for the county to enforce its zoning ordinance.”
When the time came for the vote, all four members present found they could agree that denying the application would present a “demonstrable hardship that would effectively prohibit or unreasonably restrict the use of the property,” and the variance was granted.
The BZA also approved Robert Bridges application for a tourist home to take overflow guests from the Bleu Rock Inn. At the Planning Commission this application had been opposed as an application for a bed and breakfast. Mr. Bridges agreed to apply for a tourist home instead.
“It’s not the function of the Planning Commission or our function to police the bed and breakfast industry for them,” Mr. Gottlieb said. The application was approved with the same conditions the planners recommended.
