Exempting the town from the zoning ordinance, stated Mr. Reynolds, was a viable option because the Council is answerable to its citizens, as opposed to the situation with a private owner, who is not. “Should it allow uses not acceptable to its citizens, the Council can be made to answer to the voting public.”
Other options listed by Mr. Reynolds were:
• Rezone the area to either Mixed Village Use or Village Services, thus allowing more flexibility in permitted uses
• Proceed as much as possible under the Non-conforming Use part of the zoning ordinance, which would allow the town to use the building as it has been used in past, as long as the use had not been discontunued for a period of two years
• Adopt a variation of the county’s “Adaptive Re-use” category in its zoning ordinance, which, stated Mr. Reynolds, did not have the political baggage associated with the exemption idea and could be beneficial to the rest of the town in certain cases.
