Last Wednesday the Board of Zoning Appeals (BZA) denied Lynn Sullivan’s application for a variance.
She had applied for the variance for a set of stairs leading to a deck which extended past the setback requirements on her property. The construction was completed last fall. The stairs must now be removed or placed somewhere else which would not encroach on the setback requirements.
Attdmey Douglas Baumgardner represented Ms. Sullivan at the meeting. He said that she said she knew nothing of the encroachment until after the stairs were constructed by her contractor, and that where the fault lies is unclear.
Building inspector Richie Burke said he had told the builder last August that the back property line was encroached on by the stairs. Construction on the stairs was halted, he said, but started up again in November. The builder told him that he had'told Ms. Sullivan about the problem with the stairs. According to Mr. Baumgardner, Ms. Sullivan said she had not been informed by anyone about the problem with the stairs.
