Mr. McCarthy said there might be further subdivision potential on the property “depending on how you interpret the definition of lots.”

Everyone seemed to agree the property could be divided into four parcels,without needing a special exception.

Stonewall-Hawthom District representative Sharon Pierce said that in a similar case on Mitchell's Mountain the planners had requested oversight of where houses were located.

The planners ultimately agreed on a series of conditions for the five-lot subdivision: no further subdivision will be allowed, the road must meet class two standards, the road and house construction will have to comply with erosion and sedimentation standards, and the Planning Commission will have to approve the location for any houses built.

Mr. Massie summarized the issues at stake. “Would it be better for Rappahannock County to have five lots done the way we want or the bank to do four lots anyway they want? To me the people are protected better this way.”

The motion to recommend approval of the special exception with the listed conditions passed unanimously.
