Freedom Of Choice?
Murphy maintained that ■ creation of Planning ^ ^Commissions denies freedom of choice by nullifying an “unwritten law that allows people to choose.. .where and how they will live.”
As first written, the law stated any governing body may create a local planning commission, said Murphy. When the law was amended to read every governing body shall create a local planning commission by July 1, 1976, “freedom went out the window,” he maintained. “People are no longer free to do what they wish with their land.”
All three gubernatorial candidates have gone on record a^ favoring the rights of localities to do their own planning, according to Murphy. However, “Now an appointed commission will decide what you will do with your land,” he added.
He criticized enabling legislation that allows local jurisdictions the option of adopting land use assessment. “Farmers and large landowners benefit from land use,” said Murphy, adding that land use shifted the tax burden to small, individual homeowners. “If there are high taxes to be paid, then we must all pay them,” he stated. “It’s the best way to bring about.tax reform.”
