Liable For Citizen Suit
Jurewicz said that a permit would still be issued without a signed consent order, but in this case the permit would not include less stringent interim limitations on effluent. Instead, the discharge would be measured against the new lower levels on suspended solids and biological oxygen demand (BOD).
If the effluent did not meet the new allowable levels, Jurewicz noted, the School Board would be liable for a citizens suit and “we would consider taking the School Board before the SWCB for a hearing.”
