The Rappahannock Board of Zoning Appeals affirmed revocation of P. E. Steve DeMent Ill’s special use permit at last Thursday’s meeting. “He has to comply. If he doesn’t want to comply, he can take it to court,” stated BZA Chairman Josef Gardiner at the close of the session.

DeMent’s permit to build a 70 foot by 40 foot garage and storage area in Sperryville was granted in April with conditions that required the new building to be an extension of the existing structure. Although the permit didn't specifically stipulate setback distance from the adjoining property line, BZA members have insisted that this requirement was 50 feet.

It became apparent when construction began that the new building met neither of the conditions and the BZA sent DeMent a letter in May informing him that he was violating provisions of his permit. The garage and storage shed under construction was approximately 20 feet from the adjacent property and the shed was not connected in any way with the existing building. Subsequently, a ‘‘two by four” was nailed up between the two structures.

When the violations weren’t corrected and faced with a suit from adjoining property owners Mr. and Mrs. Stuckey, the BZA suspended DeMent’s permit in June and subsequently revoked it in July.

DeMent has maintained that his new building complies with the conditions under which his special use permit was granted. A building permit issued DeMent by the Zoning Office clouds the issue. It appears to support DeMent’s contention, stating that the new structure is to be located 20
