ordinances applicable within a district must not conflict with the agricultural district law. In addition, land use decisions and ordinances affecting property adjacent to an AF District must take into account the existence of the district and the purposes of the agricultural district law.
4. Powers of eminent domain are restricted to where only 10 acres may be taken from any single farm in a district and only 100 acres from the entire district.
5. No public funds may be expended in a district for non-farm related purposes.
6. All agricultural and forestal land within a district is eligible for use value taxation.
Non-Con tiguoui Land
Paxton said that each district must include 500 contiguous acres although the land doesn’t have to be a “solid block...It can be Swiss cheese” with holes in the middle representing property owners who chose not to be included in the district.
In accordance with General Assembly amendments passed in the last session, additional noncontiguous property can be included on top of the qualifying 500 acres. This may be done, Marshall explained, if the noncontiguous land is within one mile of the boundary of the 500 “core” acres.
