Noting that Simpson was yet to be sentenced for the first-degree murder charge in Culpeper, Niles said his client still had the right of appeal. “The conviction can be overturned,” he added in arguing that Judge Snead shouldn’t consider the Culpeper case in arriving at a sentence for the Rappahannock robbery. “Technically," said Niles, the robbery of the Sperryville store “is his first conviction."
