He presented the BZA with a certificate of fact from the State Corporation Commission, noting that the Nationwide Pentacostal Evangelical Association is not the name of any organization duly registered to do business in Virginia. In addition, he noted, N.P.E.A. is not registered with the county clerk’s office.
“It’s also not a church,” Konick maintained. He reported that church organizations owning property in Virginia must by law have title held by trustees. “This property is owned in the name of an association,” he said.
In order for donations to be counted as charitable contributions, an organization must have a certificate from the Internal Revenue Service, Konick continued. "I haven’t seen onl in evidence here,” he

He proposed that limitations on lights, noise and hours for conducting services be placed on N.P.E.A. so as not to interfere with rights of neighbors to enjoy their property.
