lunch recess, the BZA reconvened with Admiral Gardiner’s announcement that no action will be taken on the variance request until May 22. Gardiner said the board wanted to find a solution acceptable to both sides and also must await legal research from the commonwealth’s attorney.
He mentioned the possibility of the property owners applying for a rezoning back to agriculture and then seeking a special use permit rather than a variance. He also noted that the BZA may grant a special temporary permit to allow this year’s camp meeting. “We can put as many restrictions on the permit as we deem necessary,” Gardiner added in assurance to those concerned about noise and lights from the services. He also added that the BZA “may order them to tear it down.”
Gardiner blamed “officials of the county” for wrongly granting the original permits. “The camp ground is not legal in that it never came before this board...A campground is not permitted in a residential subdivision. The health man was in error for letting them put the camper hook-ups on,” he added. Gardiner concluded that either side would be free to take the issue to court if not satisfied with the BZA’s decision.
