Having not done so, this Court cannot rule on their actions,” he noted.
“While Virginia law appears not to allow further review on a record from the BZA, and while the Board of Supervisors is not a party before the Court here, a clarification of these districts may be in order or in the alternative, the BZA may wish to conduct a hearing (to determine in which
district Johnson’s property is located) if an application for such interpretation is made to it,” Robertson said, deferring adjudication for six months “unless a lesser time is determined to be appropriate.”
