On February 8, 1833, the Virginia General Assembly passed what was entitled “Chapter 73 — An Act forming a new county out of the county of Culpeper,” and in paragraph one proclaimed the county’s name to be Rappahannock. In paragraph two, the Assembly ordered Governor John Floyd to appoint 25 persons to serve as “Justices of the Peace in and for the County” after they had taken their oaths duly administered by Samuel Simoson, a Justice of the Peace from Shenandoah County.
Paragraph five further commanded these 25 Justices to meet “at the home of Mrs. Anne Cox in Rappahannock on the first Monday of April” to appoint a Clerk, nominate officers for. the Governor to commission, and fix upon a place for holding court until necessary buildings could be constructed at the place designated by the commissioners.
